As discussed in a recent edition of this newsletter, we filed a reclamation
claim following a bankruptcy. When I followed up about a return of our shipment,
I was told that our product had been sold by the time the reclamation demand
was received. This seems unlikely. How do I prove the customer is lying?
Answer: : In the absence
of some sort of proof/documentation that the debtor is lying, you unfortunately
are in a difficult position between what you believe and what you can
prove. You probably should discuss your options with an attorney. |
