We FAX monthly statements to customers automatically if their FAX number
is in our collections database. I have read that the law is changing relating
to unsolicited FAX messages. It is something that came up at our last credit
group meeting.
What is your take on this?
Answer: I cannot offer any
legal opinion. From what I have read, the new law relates to unsolicited
FAX messages from third parties that have no previous business relationship
with the recipient. My personal opinion is that what you are doing is fine,
but if any customer asks you not to send statements by FAX I would certainly
agree to remove them.
